1. TERMS OF USE
These General Conditions of Contact regulate the use of the tactic-sport.com website owned by TEIMA 1992 SPORT, S.L. (onwards Tactic), with address at c/ Isaac Rabin 5 (Industrial Polygon of Montfullà), 17162 Bescanó, Girona. NIF B17532045, registered in the Mercantile Registry of Girona, in volume 1133, page 158 GI-20350.
In compliance with Law 34/2002, of July 11, on Services of the Information Society and Electronic Commerce (LSSICE), TEIMA 1992 SPORT, S.L, informs that it is the owner of the website www.tactic.cc.

2. USERS
To acquire any of the products shown on this website and owned by Tactic, you must be legally qualified in accordance with the Spanish Legal System.

3. UPDATE OF THE WEBSITE REFERRED TO CONTRACTING
TEIMA 1992 SPORT, SL. reserves the right to make changes and updates on the products, prices, promotions, and other conditions contained in www.tactic.cc, within its means, ensures that the information offered on the web is true and appears without typographical errors. In the event of any typographical error, beyond the control of TEIMA 1992 SPORT, SL., it will be corrected immediately. If it happens that a customer decides to make a purchase based on an error of this type, www.tactic.cc will inform you immediately of said error, and both parties may cancel the purchase at no cost if the existence of the error is justified. said mistake.
TEIMA 1992 SPORT, S.L. pays great attention to the information regarding the technical characteristics and benefits of the products, through technical descriptions, and quality photographs that illustrate the products. The manufacturers reserve the right to make changes to the articles. The images are in no case binding.
In no case will we be responsible for errors or omissions of information contained on our website. If for the buyer any of the technical characteristics of the product that he wants to buy is essential, please contact our customer service, to corroborate said information.

4. PURCHASE OF STANDARD PRODUCTS (COLLECTION)
Standard or collection products are those that you can buy at Tactic without requesting their individualization.
With the purchase of standard products, by clicking on the "buy" button you make a binding offer to purchase. Before sending the binding order, you can review the order data at any time (merchandise, quantity, price, shipping, and payment method) and, if necessary, modify it. The order process can be cancelled at any time by leaving it.
The confirmation of the entry of the order is made with an automatic email immediately after sending the order, not implying acceptance of the offer by Tactic.
If, due to a computer error, there is an error in the prices, Tactic reserves the right to cancel, and refund said order.

5. PURCHASE OF CUSTOM PRODUCTS (PERSONALIZED)
Custom or personalised products are those that have been individualised by the client, so that they are made according to the client's concept, for example. The design, the colours, or the incorporation of logos. Tactic will send you the rates and conditions for product customization by email.
Once the design, budget and delivery conditions have been established for verification, you can contact your Customer Service to confirm the order in writing. With the receipt of said confirmation by you, the contract is closed. You will then receive a brief confirmation from Tactic by email with the amount to be paid as a deposit.

6. TEAM STORE / PRE ORDER CONDITION AGREEMENTS
Purchases through TEAM STORE or PRE ORDER are part of TEIMA 1992 SPORT SL and are governed by the General Terms and Conditions set forth for www.tactic.cc, except as specified below.
1. All orders formalised through the personalised TEAM STORE or PRE ORDER will be considered FINAL and FINAL orders, regarding, among other aspects, the design, size, quantity, and garments purchased, at the time the management period expires. Returns of the garments will not be accepted, since they are personalised garments and manufactured expressly and on request.
An order will be considered firm ONLY when it meets these premises:
- Confirmation of the online order, after having filled in all the details of the order.
- Payment of the indicated amount.
The absence of any of these two conditions will be considered for all purposes as an invalid order, with no possibility of claim by the customer once the order management period has expired.
No changes to the order will be accepted once the order management period has ended, at which time the custom garment manufacturing process will begin.
2. The production of the global order will be started if the minimum order of each style, 10 units per garment, has been completed.
3. The group administrator of the TEAM STORE or PRE ORDER will be designated as the interlocutor of Tactic and will oversee transmitting the information bidirectionally in case it occurs. The administrator is responsible for reviewing, confirming, and completing the minimum order of each garment when necessary.
4. All orders processed through the TEAM STORE or PRE ORDER will be manufactured from the closing date of the same, and in compliance with the delivery deadlines previously agreed with the administrator.
5. Delivery dates are estimates depending on the volume and complexity of the global order.
6. Returns of any item purchased through this TEAM STORE, or PRE ORDER, will not be accepted, except in the case of manufacturing defects.

7. SIZE KIT
Tactic makes available to buyers of personalised products, the sending of a sample kit as well as a kit of sizes. This size kit will be at your disposal for a period of 7 days.
In the event that the samples are not returned within the period established in the delivery note, an invoice will be issued for them according to the standard price of each garment (price per unit from 10 units) according to the Tactic price list in force at the time of shipment.
For your return, the shipment includes a return label inside the kit. All garments must be placed inside a box or bag, perfectly packed, and paste the return label on the outside.
The samples that Tactic sends for quality and size verification must be treated with care, unused and unwashed. The samples must be reshipped before the date established in the delivery note. An extension of this period is only possible with prior agreement.

8. PRICES
For customers within the European Union, the prices indicated are the final prices. They contain the relevant taxes, especially VAT and all other components of the price. Shipping costs will be detailed separately on the invoice.
For customers outside the EU, all prices indicated are understood as net prices. The determining criterion is the delivery address. In the event that, according to the legal provisions in the receiving country, value added tax is applied, this will have to be paid additionally when the merchandise is received. In addition, import duties may apply, which the customer must additionally pay when receiving the merchandise. The amounts mentioned above will be collected either by the customs authorities or by the transport company in charge of the shipment.

9. PAYMENT METHODS
Payment will be made through any of the following ways:
- Payment by bank transfer; Tactic will provide the corresponding account number for said transaction.
- Purchases with credit or debit card; the user must provide the name of the card holder, the number, the expiration date and the CVV. All the information will be processed through the bank's POS.

- Payment with PayPal; PayPal enables consumers with email to send payments online safely, conveniently and cost-effectively. 10. SHIPMENTS
At Tactic we know that when you place and order through www.tactic.cc you are looking forward to receiving it as soon as possible. That is why we have thought of the best way to get your garments to you in perfect condition and in the shortest possible time.
The products of Tactic Collection have the following approximate delivery time from the date of formalisation of the order (they may suffer additional delays in promotional campaigns):

In case of delivery for personalised products, it is approximately 50 days from the confirmation of the order, although this period could vary in time of overproduction. In any case, the customer will be informed of the estimated delivery date.
The delivery period will be extended without the need for communication from Tactic, especially if the client has not complied with the payment obligation.

11.COLLECTION AND PERSONALISED SHIPPING RATES

For customization orders (custom) the shipment will be free for all those that exceed €2,500 of tax base and Tactic will assume the shipping cost regardless of the country of destination. If the order does not exceed the minimum amount of €2,500 of tax base, the shipping cost will be €10 in Spain (Peninsula and Balearic Islands, Canary Islands not included), and €15 for all those countries belonging to the EU (in addition to Andorra and Switzerland). For all those other countries that do not appear within the EU and do not reach the minimum amount to have postage paid, the shipping cost must be consulted with the Customer Service that accompanies you in the purchase process.

12. PROPERTY RESERVATION
The merchandise will remain the property of Tactic until compliance with the payment requirements included in the shipping contract with respect to Tactic.
The customer is obliged to treat the merchandise with care until the change of ownership occurs and it becomes his property.
The rights related to industrial and intellectual property (by way of example and not limitation: trademarks, logos, texts, photographs, icons, images, etc., as well as graphic design, source code and other software elements contained on the website www.tactic.cc) are owned by TEIMA 1992 SPORT, S.L. or of the representative companies and manufacturers of the products and services offered. Therefore, they are subject to intellectual and industrial property rights protected by Spanish and international legislation.
Without the prior written authorization of TEIMA 1992 SPORT, S.L., or, where appropriate, the representative or the manufacturer of the product that owns the rights, it is not allowed to use, reproduce, transmit, manipulate, as well as any use that exceeds of a normal and necessary use for the visit of the page and the use of the services offered.
Access to the services provided does not imply on the part of TEIMA 1992 SPORT, SL. waiver, transmission or total or partial transfer of the rights derived from intellectual and industrial property, nor does it attribute rights of use, alteration, exploitation, reproduction, distribution, or public communication of these contents without the prior and express written authorization of the respective owners. of said rights, without prejudice to the right to view and obtain a private security copy of such content, provided that said right is exercised in accordance with the principles of good faith and provided that the intellectual and industrial property of the owner of such rights remains unchanged, is used for non-commercial purposes and exclusively for the user's personal information.
The responsibility derived from the use of materials protected by the intellectual and industrial property rights contained in this page will correspond exclusively to the user.

13. RIGHT OF WITHDRAWAL
Users may revoke the purchase of standard products (which do not include customization) within 14 calendar days without the need for justification. The withdrawal period will expire 14 calendar days after the customer or a third party for the indicated customer, other than the carrier, acquired material possession of the goods.
To exercise the right of withdrawal, you must notify us of your decision to withdraw from the contract through an unequivocal statement via email to the address tactic@tactic-sport.com. If you resort to that option, we will notify you without delay, the receipt of said withdrawal.
If the cause of the return is that the returned item is defective or does not correspond to what was requested in the order, Tactic will bear the costs of the return and new shipment, even if they do not reach the minimum amount necessary for postage paid.
If the reason for the return is that the order does not satisfy you, we will refund the amount, including delivery costs (except delivery costs if you have chosen an option other than ordinary delivery, in this case only the costs assigned by the website for ordinary delivery) without any undue delay.
The return will be made no later than 14 calendar days from the date on which you inform us of your decision to withdraw from this contract.
The reimbursement will be made using the same means of payment that was used in the initial transaction, unless you have expressly provided otherwise, and if it does not entail additional expenses.
Tactic reserves the right to withhold the reimbursement until the goods have been received and their status reviewed.
In personalised products, due to the specific conditions of the product and its total customization, only those products that are defective may be returned.

14. DUTY
Possible customs duties, taxes, and other charges (for international shipments and those to the Canary Islands) are not included in the price of the item or in the shipping costs. These charges are the buyer's responsibility*.
*Including purchases from the UK on or after 31st October 2019 (Brexit)
If the buyer refuses to pay these charges and requests the return of the order, Tactic will refund its value less the cost of shipping and subsequent return.

15. WARRANTY
All our products come with a 2-year legal warranty. In the case of collection items, a free repair service will be provided in case of a factory defect, for which Tactic, as the seller of the product, is responsible under legally established terms. To benefit from our warranty, the customer must contact Tactic, who will collect the defective items for examination of the origin of the defect. If Tactic determines that the defect is not due to consumer misuse, the item will be repaired free of charge. If the defect is not due to a factory issue, Tactic will not cover the costs of transportation or repair.
To make use of the collection product warranty, it will be necessary to send an email to tactic@tactic-sport.com with details and images of the garment's damages, including a copy of the purchase receipt or original order number. Deficiencies caused by negligence, impacts, improper use or handling, improper tension, or materials subject to normal wear and tear are not covered by the warranty. Therefore, the warranty does not cover the repair of damages caused by external factors unrelated to the product.
In textile printing, slight variations in tone, both in colour tests, as well as in subsequent delivery, are always possible and unavoidable. Tactic maximises its effort to reproduce the colours of the catalogue (online or in brochures) and of its website in the most realistic way possible. In particular, the colours that can be seen on the Tactic website depend on the configuration of the client's screen, so Tactic cannot guarantee an adequate comparison of colours. That is why we recommend requesting a colour sample in fabric to see the result.
In those incidents that justify the use of the guarantee, the repair, replacement of the item, reduction or return will be chosen, in the legally established terms.

16. RESPONSIBILITY
Tactic excludes its liability to the customer for slight negligence, if this does not affect essential contractual obligations, damages arising from injury to life, body or health or the guarantees arising under the Law of Liability for Defective Products. The same applies to infringements by agents or legal representatives of Tactic. An essential contractual obligation occurs in the obligations whose fulfilment allows the correct execution of the contract or in which the client can and must rely on their fulfilment.
Tactic's liability to an employer for slight negligence of an essential contractual obligation is limited to foreseeable and typical damages.

17. COPYRIGHT / THIRD PARTY, RELEASE OF LIABILITY, INADMISSIBLE DESIGNS
If the customer provides a motif of his own or exerts any other type of influence on the product (e.g., text customization), the customer assures Tactic that said design, text and motif are exempt from third-party rights. The customer will be solely responsible for any infringement of copyright and samples, rights of protection of personality or rights to the name. The customer also guarantees not to violate the rights of third parties by individualising the product. Mainly, in the case of using legally protected logos, images, slogans, fonts or designs, the client is responsible for obtaining authorization from the legal owner in writing and presenting it to Tactic without being requested.
The client will release Tactic from all demands and rights that are asserted due to the violation of such rights of third parties, provided that the client is responsible for the breach of duty. The client will be responsible for all defence expenses and other damages caused to Tactic.
Designs that contain images or inscriptions or other wishes of the client that affect the privacy of third-party rights, that contain pornography, intended for the distribution of prohibited propaganda, or incite to commit crimes or participate in them, will not be produced by Tactic.
Clubs should be aware of the possible policies and guidelines of their leagues and associations regarding their equipment. Tactic does not assume any obligation or responsibility for possible infractions.
Tactic has the right to present its products on its website (on-line shop), in its catalogues (and on-line catalogues) as well as in other ways of presenting products, advertisements, etc. regardless of its form (electronic or written), and in exhibitions.
Tactic can mention the client in different media as a reference. This also includes the mention and use of any of the protected names or logos. Tactic will not be obliged to mention the client. The client may restrict or prohibit being mentioned by Tactic.
In the case of production error or overproduction, Tactic reserves the right to use said products as samples available to other clients or to be used in internal controls

18. FREE RETURNS
If you are not 100% satisfied with your purchase, Tactic offers you the possibility of returning the Collection items, if they have been purchased directly through our website www.tactic.cc and you are within 30 calendar days from that you received on order.
In the case of having purchased the product at one of the official Tactic points of sale, contact the store to process the return.
Before starting the product return process, keep in mind that the items must be in their original packaging, they must also be in "AS NEW" condition, that is, unwashed and unused, keeping their label. Please make sure that the product is well packed in its original bag and protected with an opaque bag or box to avoid damage during transport and thus arrives in the perfect condition that it was sent to avoid problems in this process.
CUSTOM items, as well as PREORDER or TEAMSTORE items will not have a return option.

19. HOW DO I START THE RETURN PROCESS?
To start the process of returning or cancelling the purchase, you must contact us by email, indicating the order details, to the address tactic@tactic-sport.com. As soon as possible (24/48h) a specialised salesperson will contact you.
Tactic will bear the shipping costs in case of returns worldwide (except from categories named as International and Rest of the World), if the collection is scheduled by Tactic and, in no case, if the customer has chosen a different shipping method.
In the case of partial return of items that involves not complying with the minimum amount for an order with free shipping, Tactic will refund the amount of the returned items, but subtract the amount of the expenses of the first shipment.
In any other cases in which the shipping costs are borne by the customer, Tactic will refund the amount of the item by subtracting the amount of the shipping costs.
PERSONALISED items, as well as PREORDER or TEAMSTORE items will not have a return option.
Any transport operator that is not one of those offered by Tactic, will be under the responsibility of the client. Tactic is not responsible for loss or damage caused by independent carriers.

20. HOW DO I RECEIVE MY MONEY?
Tactic offers 14 calendar days from when the customer receives their order, once you start the return process and the product arrives at our facilities, the items will be reviewed. Once it is verified that they are in perfect condition and have not suffered any damage, the corresponding economic amount will be refunded within a period of 7 working days.
PERSONALISED items, as well as PREORDER or TEAMSTORE items will not have a return option.

21. DEFECTIVE PRODUCTS AND REPAIRS
We control the quality of each product. However, in rare cases, there may be a manufacturing defect. If you believe that your product has a manufacturing defect, please contact us.
Products damaged because of excessive use over a long period of time will not be considered defective.
Tactic will bear the shipping costs in case of returns if the collection is scheduled by Tactic, and in NO case if the customer has chosen an alternative shipping method or on their own. In cases where the shipping costs are borne by the customer, Tactic will provide a label with the address to which you must send the package, by your own means. If you need us to help you find a transport agency, you can request it.

22. ORDER CANCELLATION PROCESS
You can process the cancellation of your order if it has not been processed. That is, even if the payment has been made, the order has not left our facilities, or in the case of a CUSTOMISED order, it has not passed to the production line.
To process your cancellation, please send us an email to tactic@tactic-sport.com with your personal data and the identification data of the order. In the case of a PERSONALISED order, contact your assigned Customer Service.

23. DESIGN CONDITIONS (CUSTOM)
The designs made by Tactic are the exclusive property of the latter, and therefore Tactic may make use of said designs for promotional and informational purposes.
The client declares under his sole responsibility that he has the relevant authorizations for the use of both the logos and any other graphic that has been provided to Tactic to include in the design.
As for the designs that have not been completely made by Tactic and have been sent by the client, the confirmation of the order by the client authorises Tactic to use it for merely promotional and informative purposes.

26. APPLICABLE LAW AND FORUM
This purchasing system is subject to the legislation in force in Spain (Civil Code, Commerce Code, Law 7/1996, of January 15, on the organisation of retail trade, Law 7/1998, on the General Contracting Conditions, Law 26/1984, General for the Defense of Consumers and Users, Royal Decree 1906/1999, of December 17, regarding telephone and electronic contracting with general conditions and Law 34/2002, on Information Society Services and electronic commerce). In accordance with Law 34/2002 of July 11, the contract will be presumed to be held at the seller's address (Spain). If in your case there are disagreements that may arise because of this contractual relationship and cannot be resolved amicably, it will be submitted to the Courts that are considered competent in each case.
